CHAPTER 155: HOUSING CODE RENTAL DWELLING

As used in this chapter, the following terms have the following meanings unless otherwise designated:

“DWELLING UNIT.” A single unit providing complete, independent living facilities for one or more persons including permanent provisions for living, sleeping, eating, cooking and sanitation.

“HOUSING CODE.” The Building Officials and Code Administrators International Basic Property Maintenance Code, First Edition, 1978, and all amendments thereto as adopted in Chapter 154 of the City Municipal Code.

“ORGANIZATION.” Includes a corporation, government, governmental subdivision or agency, business trust, estate, trust, partnership or association, two or more persons having a joint or common interest, and any other legal or commercial entity.

“OWNER.” Any person, agent, firm or corporation having a legal or equitable interest in the property.

“PERSON.” A corporation or co-partnership as well as an individual.

“PREMISES.” A lot, plot or parcel of land including the buildings or structures thereon.

“RENTAL BUILDING.” A building containing one or more rental units.

“RENTAL DWELLING UNIT.” A dwelling unit in a residential premises covered by a tenancy agreement.

“RENTAL UNIT.” A rented dwelling unit or rooming unit.

“ROOMING UNIT.” Any room or group of rooms forming a single habitable unit used or intended to be used for living and sleeping, but not for cooking or eating purposes.

“SECURITY DEPOSIT.” Any advance or deposit of money, regardless of its denomination, the primary function of which is to secure the performance of a tenancy agreement for rental premises or any part thereof.

“TENANT.” Any person entitled to occupy a rental unit under a tenancy agreement to the exclusion of others.

“TENANCY AGREEMENT.” Includes all agreements, written, oral or implied, and valid rules and regulations embodying the terms and conditions concerning the use and occupancy of a rental unit and premises.

“TRANSIENT OCCUPANCY.” Occupancy which is less than two weeks duration in the same or similar units owned by the same owner.

§ 155.002 PURPOSE; RULES OF CONSTRUCTION.

This chapter shall be liberally construed and applied to promote its underlying purpose, which is to encourage the maintenance and improvement of the quality of housing in the city.

§ 155.003 COMPLIANCE REQUIRED; APPLICATION OF CHAPTER.

(A) No person shall occupy or maintain a rental unit within the city unless in accordance with the provisions of this chapter.

(B) This chapter applies to rental units located within the city, including governmental or public agencies acting as landlords, but shall not apply to the following arrangements unless the arrangements are created to avoid the application of the chapter:

(1) Occupancy by the purchaser of a dwelling unit under a contract of sale;

(2) Transient occupancy in a hotel, motel or other similar lodgings;

(3) Owners who reside in a single-family dwelling unit but who wish to lease to individuals or a family while they are absent from the city for short periods of time, not to exceed one year, and who intend to return to their single-family dwelling unit at the expiration of the lease period;

(4) Owners who occupy the premises, rent to one tenant, and share common bathroom and kitchen facilities with the tenant.

§ 155.004 INVENTORY AND DAMAGE LISTS; SECURITY DEPOSITS.

(A) The owner or his agent shall contact the tenant and arrange a joint inspection of the premises to occur within ten days of the tenant's occupancy of the rental unit. The owner or his agent and the tenant shall at that time jointly complete an inventory and damage list, and this shall be signed by all parties to the tenancy agreement. Duplicate copies of the inventory and damage list shall be deemed a part of the tenancy agreement.

(B) The owner or his agent shall contact the tenant and arrange a joint inspection of the premises to occur at the end of the tenant’s occupancy and prior to the occupancy of the next tenant. Any damages to the rental unit shall be noted on the inventory and damage list, and the list shall thereupon be signed by the parties. If the parties can agree to the cost of repair, such portion as is due the tenant, shall be refunded within 45 days.

(C) (1) The owner or his agent shall have a duty to initiate the joint inspections; however, both the owner or his agent and the tenant shall have an affirmative duty to make a good-faith effort in scheduling joint inspections. In the event the owner or his agent is unable to schedule an inspection with the tenant through contacting the tenant by telephone, personal message or personal contact, the owner or his agent may show compliance with this section by producing the following: a carbon copy of a letter to tenant stating the time and place of inspection; and, a normal business record showing that this letter was mailed to the tenant by first class mail at least two days prior to the date of the inspection.

(2) If the owner or owner’s agent cannot arrange a joint inspection pursuant to the above procedures, the owner or agent shall complete the inspection, noting on a signed and dated inspection report any damages which exceed normal wear and tear.

(D) The owner’s or agent's copy of all inspection reports shall be retained for a minimum of the present lease period and two subsequent lease periods, or for a period of four years, whichever is less.

§ 155.005 DISCLOSURE.

(A) A party signing a tenancy agreement as owner shall disclose therein or in a separate writing furnished to the tenant at or before the commencement of tenancy the name and usual address of each person who is:

(1) Authorized to manage the premises; and

(2) An owner of the premises or his agent who is authorized to act for and on behalf of the owner for the purpose of service of process and for the purpose of receiving all notices and demands.

(B) In case of an oral tenancy agreement, the owner or his agent, upon written request, shall furnish the tenant with a written statement containing the information required by division (A) of this section.

(C) The information required by this section shall be kept current. The provisions of this section shall extend to and be enforceable against any successor owner or manager.

(D) In addition, the owner or owner’s agent shall provide to each tenant, at or before the commencement of occupancy, a summary of the tenants' and owners' rights and responsibilities, in such form as shall be prescribed by the Building Commissioner. For purposes of this division it shall be sufficient if the owner furnished one copy of the summary to each rental unit at or before each change in occupancy and obtains the signatures of the parties to the contract on the summary.

(E) The Building Commissioner shall furnish, upon request, to each registered owner or owner's agent of rental property subject to this chapter a copy of the City Housing Code. The housing quality ordinance and a sufficient number of copies of the summary required by division (D) of this section shall be provided to each owner or owner's agent to permit distribution of the summary to each rental unit. Owners shall contact the Clerk-Treasurer for additional copies as needed. The Clerk-Treasurer shall make available additional copies of the summary as owners need them. Owners who first register rental property after the effective date of this subsection shall be furnished the housing quality ordinance at the time of registration. Owners already registered on the effective date of this subsection shall be furnished the housing quality ordinance no later than the time of the next cycle inspection.

§ 155.006 REGISTRATION OF RENTAL UNITS REQUIRED.

(A) No owner of real estate within the city shall use real estate for the purpose of erecting or maintaining a rental unit thereon without registering such property with the Building Commissioner’s Officer of the city. Such registration shall be effected by furnishing to such department, upon a form furnished by the department, the following information:

(1) Name of owner;

(2) Address of owner;

(3) Street address of property;

(4) Brief description of type and number of rental unit(s); and

(5) Name and street address of agent, if any, authorized to receive notification of complaints, damages, emergencies, substandard conditions or other communications, including service of process. The address of any agent so designated shall be within the state. Any owner who does not reside in the state shall be required to designate such an agent.

(B) The registration form shall be signed by the owner.

(D) Notification of the owner or his agent at the address shown on the registration form shall constitute sufficient notice pursuant to any provision of this chapter.

(E) It shall be a violation of this chapter for any owner to maintain a rental unit which has not been registered in accordance with this section.

§ 155.007 INSPECTION; RIGHT OF ENTRY; FEES.

(A) (1) Each rental unit and premises within the city shall be inspected by the Building Commissioner or his duly authorized assistant immediately prior to the expiration of its occupancy permit, to establish the compliance with the Housing Property Maintenance Code, Health and Hospital Corporation of Marion County and the Marion County Department of Metropolitan Development Dwelling District Zoning Ordinance. Occupancy permits shall be issued for a three, four or five year period, as determined by divisions (B), (C), (D) and (E) of this section.

(2) No rental unit having a current occupancy permit shall be inspected in good faith more often than is required for the renewal of the occupancy permit, unless a request for inspection is made as provided in division (E) of this section.

(B) Three-year permit. A three-year occupancy permit shall be issued for each rental unit upon which a cycle inspection or a complete off-cycle inspection is performed after the effective date of the ordinance codified in this section, where the owner or agent fails to have the unit re-inspected and found in compliance with the inspection report, excluding exterior painting, within 60 days after such report is mailed to the owner or agent.

(C) Off-cycle inspections may be done at the discretion of the Building Commissioner, upon the written, signed request of any resident of the city, any governmental agency, or the rental unit’s tenant, the tenant's legal representative, the owner, or the owner's agent. An off-cycle inspection shall be confined to the defects complained of, if any, by the person requesting the inspection unless the Building Commissioner determines that the condition of the rental unit or premises has deteriorated since the last cycle inspection to such an extent that a complete inspection is required to effectuate the purposes of the Housing Property Maintenance Code, in which case a complete off-cycle inspection is performed, a new occupancy permit shall be issued upon compliance. Such permit shall be for a three-year period, provided all violations excluding exterior painting are satisfactorily completed, and the unit re-inspection within 60 days after the receipt of the inspection report by the owner or owner's agent. Such permit shall be for a three-year period if the owner or agent fails to have the unit re-inspected and found in compliance with the inspection report, excluding exterior painting, within 60 days after such report is mailed to the owner or agent.

(D) All cycle inspections and complete off-cycle inspections shall be charged an inspection fee to be determined by reference to the schedule in division (G). Complaint and limited off-cycle inspections shall not be charged an inspection fee. An administrative fee or three times the inspection fee shall be assessed in addition to the inspection fee for any rental properties subject to this code and operating without a valid Rental Occupancy Permit. First re-inspections, and re-inspections necessary to obtain information for appeals to the City Council shall not be charged an inspection fee. The fee for each subsequent re-inspection that requires entry to the rental unit after the first re-inspection shall be $25 per rental unit. The failure of a property owner or his appointed representative to meet the inspector(s) at a confirmed scheduled appointment when the failure results in the inspector being unable to complete the inspection, shall cause an assessment of a no-show fee of $25. Inspectors shall be required to remain at the property until 15 minutes past the appointed time. All fees shall be paid by the owner or his agent prior to the issuance of an occupancy permit. All fees are to be paid within 30 days of assessment or any occupancy permit will rescind.

(E) The Fee Schedule for inspections shall be as follows:

NUMBER OF UNITS/RENTAL BUILDING: FEE

First Time Inspection:

Single family/one unit rental building: $40.

Duplex/two unit rental building: $50.

3-4 units per rental building: $65.

5-8 units per rental building: $90.

9-12 units per rental building: $115.

13-18 units per rental building: $150.

19-25 units per rental building: $185.

26 units and over per rental building: $245.

Regular Inspection:

Single family/one unit rental building: $30.

Duplex/two unit rental building: $40.

3-4 units per rental building: $55.

5-8 units per rental building: $75.

9-12 units per rental building: $100.

13-18 units per rental building: $130.

19-25 units per rental building: $165.

26 units and over per rental building: $225.

(F) Unless waived by the landlord or tenant, the following procedure shall be used to obtain entry to rental units for the purpose of inspection. The owner of the unit shall be contacted and a date shall be established for inspection. The owner shall also furnish to the Building Commissioner a current list of tenants in each rental unit. The Building Commissioner shall then send a letter to each tenant informing them of the date of the inspection. If no response is received from the tenant, consent to enter will be presumed. An official record shall be maintained of all notices required by this section and all responses received to the notices. The landlord shall be responsible for granting access to the inspector upon presentation of a copy of the official record of notices and responses. If the tenant refuses entry for inspection after proper notification, the Building Commissioner shall not inspect without first obtaining a search warrant.

§ 155.008 OCCUPANCY PERMITS.

(A) All rental units and premises inspected pursuant to Chapter 154 and found not to be in violation of the housing code shall be issued an occupancy permit by the Building Commissioner. Upon registration of a rental unit not previously used as such, the Building Commissioner shall issue a temporary occupancy permit which shall be in effect until the unit has been inspected and either an occupancy permit has been issued or the temporary permit is revoked as provided in division (D) of this section.

(B) All rental units shall be required to have a current occupancy permit to be displayed on the inside of the main entrance of the unit. The permit shall contain the name of the owner or his agent and the expiration date of the permit.

(C) The owners of rental units and premises found to be in violation of the housing code shall be notified in writing of the reason for disapproval and the reasonable time period during which compliance with the housing code is expected.

(D) At the end of the time period specified if the notice described in division (C), any rental unit or premises found to be in violation of the housing code shall be re-inspected by the city at the request of the owner or his agent after such owner or agent has effected those corrections and additions required by the city as a result of any previous inspection, and upon such re-inspection such rental unit and premises shall be approved or disapproved for an occupancy permit. If re-inspection is not requested by the owner or his agent at the end of the time period specified in the notice described in division (C), or upon re-inspection the unit and premises is not approved, any occupancy permit shall be revoked.

(E) It shall be a violation of this chapter for any owner to maintain a rental unit without an occupancy permit.

§ 155.009 RETALIATORY EVICTION PROHIBITED.

It shall be a violation of this chapter for any owner or his agent to bring or threaten to bring an action for possession for the purpose of retaliating against a tenant for requesting an inspection as provided for in division (C) of § 150.307.

§ 155.010 PENALTY.

Any person, firm or corporation who violates any provision of this chapter shall, upon conviction thereof, be subject to a fine of not more than $100 and other penalties provided in § 150.999 General Penalty of the City Municipal Code. Each day that a violation continues shall be deemed a separate offense. In addition, the City Building Commissioner may:

(A) Declare a rental unit to be unsafe as provided by the Housing-Property Maintenance Code in § 154.051.

(B) Issue an emergency order where immediate action is required to protect the health and safety of the public or of the occupants of the rental unit as provided by the Housing-Property Maintenance Code in § 154.061.

(C) Seek any of the additional remedies provided by the Housing-Property Maintenance Code in § 154.082 which provides for an appropriate action or proceeding at law or in equity against the person responsible for the violation for the purpose of ordering him to:

(1) Restrain, correct or remove the violation or refrain from any further execution of work,

(2) Restrain or correct the erection, installation, or alteration of such structure,

(3) Require the removal of work in violation, or

(4) Prevent the occupation or use of the structure, or part thereof erected, constructed, installed or altered in violation of, or not in compliance with, the provisions of this code, or in violation of a plan or specification under which an approval, permit or certificate was issued.

§ 155.011 SEVERABILITY.

If any provision of this chapter or the application thereof to any person or circumstances is held invalid, the invalidity does not affect other provisions or applications of this chapter which can be given effect without the invalid provision or application, and to chapter are severable.

Someone needs to ask the Mayor and EACH member of the City Council during the meeting February 6th if they are in favor of enforcing the Codes regarding property in the City of Beech Grove. That way they will be on record as to their commitment to fixing the City and readying it for economic development. Each one of them promised that they would work for us when they ran for office, let's see them walk that talk.

Could Dan McMillan please confirm that Dennis Buckley has in fact reduced the amount of money he is being paid by the City of Beech Grove to match his campaign promise of only taking 24k? From his website..."• Reduce the Mayor’s salary to $24,000 and shift the savings within the Mayor’s budget to provide a higher level of service to the
citizens." It would great if Clerk McMillan could provide us with the payroll statements for Dennis Buckley. Thanks in advance Dan.

Something Going on with the BGPD?

There seems to be a need for there to be Thread on this issue as it just might become one.

I am going to repost what OTHERS have posted about the BGPD so far and they can pick it up from there.

But please feel free to tell all your buddies that I posted it like you usually do.

Funny how when someone asks me why I posted something then I have them go to the Blog it's usually someone else who posted it. "You People" are priceless. lol.

Bgpd should use mopeds, seeing as it takes them forever to get somewhere and while there they are useless. It would at least save gas. Or paint the cars neon orange for bg colors, that way there less likely to want to joyride them.

Four officers live in BG. I doubt the poster ever saw one "hours" away in their car when they can only go as far as surrounding counties. But I'm sure you happened to be sonewhere hours away from BG at the same time a BG cop was in their car. Sure.

Before this thing gets to far out of hand.

Each BGPD officer is allotted a certain amount of fuel per month, anything over that comes out of their own pocket.

Under Chief Witmer the BGPD bought six new vehicles out of the asset forfeiture money and ordered 4 new TAHOES, as Ford will no longer make the Crown Vic.

These vehicles will be paid for out of the asset forfeiture as well and do not need approval from the mayor the council or the board of works.

Girls High School Softball Fiasco Continues for a 3rd Year!

If anyone can find a way to explain to me how this could possibly be going on still I would love to hear it.

I have heard lip service from a School Board Member(not Rick) who is up for Re - Election this year about how things were going to change in the School Systems.

Get a hold of the School Board members and see if they know what it going on.( One does)

I would like to point out that the request was fulfilled within 3 days and didn't require Brian Bosma or hundreds of dollars of City money to fulfill it. Paul Kaiser and I may disagree on some issues but the guy is task oriented.

I have attached the 2011-2012 CO-CURRICULAR LIST that we include in

our annual August personnel meeting. All members of the school board

were present, the vote was 7-0 for the personnel report as presented

in the August meeting where certified teaching contracts circulated

for signature and the co-curricular list was made available. Some

coaching positions are blank at that time and require a written

recommendation after that date from the athletic director or building

principal after the decision to hire an employee is made. In some

instances these decisions have not been finalized.

The interesting part is that I have been asking to tell Mayor Buckley to his face for over a month and he still has not agreed to a meeting. Also it's interesting to note that Warner Wiley has the stones to impose his son on the City of Beech Grove but has refused to attend the meeting.

Let's get something straight which might stop all the stupid phone calls and emails. Once I explain it, everyone to a person completely understood and some even apologized because they had been told by some goof that I had posted what I didn't. I never posted anywhere that I didn't like Dennis or didn't think he was going to do a good job. I posted that I thought some of his appointments were wrong. This is the part that both the Republicans and the Democrats don't understand. It's ok to say that you think something is wrong without the whole world coming to an end ok? I have found through this that both Parties are exactly alike on this. If you say you disagree with one part of something then you are going to hell for going against the party which is incredibly narrow minded and frankly you are embarrassing yourselves. Once the Democrats thought that I had "Turned" on Dennis they all went crazy I guess. lol.

What you will see posted below is taken from the thread below this one. You will see once and for all that on the surface the fine upstanding citizens of Beech Grove are the same no matter what side of the Political Landscape they come from.

My hope is that you will find this both as Hilarious and Pathetic at the same time as I do.

Well I doubt that this will make it on the blog but what the hell.

Seems that there is some confusion or mixed signals coming from Mayor Elect Buckley AND MAYBE HE WAS LESS THAN HONEST WITH US.

When Warner Wiley's name was on the Buckley campaign info we were told no big deal no ties just needed a name, THE NEW CITY ATTORNEY, CRAIG WILEY

When we were told Buckley was running as himself, no party, wants to work with the best people and will appoint the best people no matter their party or politics, OOPS AGAIN DON'T SEE A REPUBLICAN IN THE NEW GROUP. as far as the Fire and Police Chief positions the good ol boy system is back at full strength.
When Buckley told us on our front porches we believed he would bring dispatch back and had a plan to do it. Not so much.
Dilk and Wright did a lot of bad things to the city, but to start out lying before you are sworn in has to be a new low.

And as far as the police and fire go, you can't go wrong with Rob Cheshire and Mark Swartz. Maybe before you post you should know what you are talking about first. And in closing Santa Claus came yesterday but my true Christmas gift is going to be when Hogsett shows up, I will make sure I have my popcorn for that.

The Blog Lives to Fight Another Day...

After being bombarded with requests to keep the Blog intact I have agreed to do this.

Anyone who has a document that they want posted on the Blog can either email it to me or bring it to me. My cell number is on the Blog profile, I am easy to get a hold of these days.

Apparently there are many who do not trust anyone with the keys to the City and would like for there to be a place to post documents and discuss issues.

Even though I think have traded up with the Mayor who was elected we should all keep an eye on how things are handled, we have all been promised things before and look where it got us when we stopped checking up on things.

I will not be the one requesting Documents, you will be. I was amazed at how many people still wanted me to do their dirty work for them instead of them doing it themselves. The people that would have made it difficult for you to find out what you want to know are gone, so have at it.

From what I understand of the new Clerk Dan McMillan, he is more than willing to let anyone have whatever documents they want whenever they want them.

If you want to know how much we spent on the wastewater gig with Brian Bosma, the REAL documents regarding the finances of the money losing court, etc. Get it then give it to me and I will post with it an update being posted on the FB page for the Blog.(I am in the process of removing all the previous posts on the Blog FB page.)

I will allow anonymous posting of comments when those comments are about whatever the document or news story is with there being no comments regarding people. If you have an opinion about someone then tell them to their face, and that includes me. Blog will stay up but there will be no more posting.

After spending 6 long years fighting (hopefully) the good fight I have decided to step back from Politics in Beech Grove.

Very soon posting on the "The Other Side of Beech Grove" Blog and Facebook pages will end and there will be no involvement by myself in the School Board elections that are coming up next year.

I have given enough time to others and will now spend my time with those closest to me as they have sacrificed more than most in BG just by the association with me also as you all know.

I want to be understood and be perfectly clear about this... I am stepping away before anything has been offered to me and there were no promises made before the election as to a position for myself that was not fulfilled by anyone. This is a clean break.

One day after the freakin election is over and the Super at the Beech Grove Schools seems to be at it again not protecting the kids.

Which School Board members are up for re election next November? They better get it together or they will get kicked out just like the Politicians that run the City did.

Except for 1 School Board member, the rest of them failed our kids last year with the Coaching Bullying issue and helped Kaiser sweep it under the rug, whoever is up for election needs to go bye bye.

School says it already addressed problem

INDIANAPOLIS (WISH) - Beech Grove City Schools has a policy in place to curb bullying. One parent, though, said that policy failed her daughter.

With tears rolling down her face like paint on a blank canvas, Dusti Clubs admitted this school year has been difficult. Since the start of the year her 9-year-old daughter has been bullied. The mother of two said she tried contacting administrators. When that didn’t produce the results she wanted, though, she filed two police reports.

“I thought maybe we would get somewhere if the police were involved,” she said.

The reports document the attacks. There were verbal assaults on Facebook, physical attacks on the playground, impromptu visit to the doctor’s office.

“She said she couldn't breath, and her chest was hurting her,” Clubs said, looking emotionally drained.

Beech Grove City Schools Superintendent Paul Kaiser declined our request for an on-camera interview, but he did talk about the incident at length over the phone. He said the district addressed the problem and also the bully.

Under the school system’s policy, the first step in such situations is a meeting with the victim and the bully. The second offense results in the student being suspended from school. The third and final strike leads to expulsion from school.

Suellen Fried, founder of Bully Safe USA – who is teaching a three-day seminar on bullying prevention at Washington Township schools - said a police report isn’t a good first step for parents. She said parents should first contact the school and go through its policies and procedures, documenting each time they speak with school officials. She recommended first contacting the school’s guidance counselor, then principal, superintendent, and finally the school board, if necessary.

But if nothing changes, Fried said, parents then have the right to sue the school district.

As for Clubs, it’s unclear what her next step will be. She said she is contemplating pulling her daughter out of Beech Grove Schools.

“My father lives in Avon,” she said. “I’m thinking about pulling her out and making her go to school out there.”

Marion County election board holds emergency meeting

The Marion County Election Board held an emergency meeting Monday, just a day before this week's municipal elections.

County Democrats are accusing Republicans of aggressive campaign tactics, including concern about misleading calls directing voters to the wrong polling places.

"This is an emergency. This is a very serious matter that has to be addressed. Tomorrow is Election Day and we have reason to believe that there are calls being made - and who else would be making them but the Republican Party - to our voters, Democratic voters, attempting to confuse them, attempting to direct them to polling places that are not their own. The other thing that is so concerning is that 760 people in this community have been designated as challengers, including state representatives, candidates who are on the ballot, the mayor of Beech Grove, Mayor Dilk, is on the challenge list. That is unprecdented and this is serious," said Marion County Clerk Beth White, a Democrat.

But county Republicans downplayed the allegations.

"This has simply been a dog and pony show by the Marion County Election Board to assist their chairman, Ed Treacy and the Democratic Party and allow him an opportunity to try to vilify the Marion County Republican Party the day before the election. It's shameful. It should never have happened. It certainly doesn't rise to the level of an emergency," said Kyle Walker, Marion County Republican Party chairman.

Walker said some of the challengers cited on the list who are candidates will not be serving in that capacity Tuesday.

Meantime, early voting ended Monday afternoon. Early voters totaled 8,709 people compared to 2,738 in 2007 and 10,697 in 2010. Early voters are defined as those people who cast a ballot in-person at the clerk's office.

As of Monday the total absentee count (which includes the total by-mail, in-person, traveling board and military and overseas) for the 2011 municipal election is 18,766. Absentee vote-by-mail ballots are due no later than 6 p.m. on Election Day, Tuesday, November 8. Civilian vote-by-mail ballots received after 6 p.m. Tuesday cannot be counted.

All politics aside Mike Jarvis is something special that Beech Grove needs to embrace. The guy decides that he truly wants to help Beech Grove get back to what it once was and takes it upon himself to get it done.

Mike has had no fundraisers, no party to back him, no good ole boy network to depend on for help.

Mike also pledges to donate HALF of his income as a City Council Member to the Youth Sports Organizations in Beech Grove.

This guy had spent his OWN money, taken an inordinate amount of time away from his very supportive family in order to do one thing.

Work hard for us to help fix what is broken.

If you live in District 2, I can't think of a better guy to have speaking out to solve the problems that have never been addressed in your neighborhoods.

Show BOTH parties that you want to be heard, you want to be served, and you aren't going to put up with all the infighting and "It's my turn now" power struggles.

Dear Editor,

My name is Michael Jarvis and I am running as an Independent candidate for Beech Grove City Council, District 2. I grew up in Beech Grove, graduated from Beech Grove, enlisted in the military immediately after graduation, retired after 26 years of service and moved back to Beech Grove. Here is my plan and qualifications to make District 2 successful.

As your elected official on the Beech Grove City Council, I will be the best possible steward of public trust that I can be. I will base my decisions on good ethics, character and the public interest of District 2. I will focus on common sense fiscal planning and transparency to the City Council. I want our public safety and quality of life in Beech Grove to be preserved for all generations.

Our roads, alleys, sewers and Main Street are my top priorities. By completing long-past-due maintenance on the roads, alleys and sewers, we will be able to establish a service schedule that will enable us to correct issues as they arise. Our Main Street is in desperate need of revitalization. By fixing the roads and storm water drainage, our merchants will enjoy more business and not have to worry about rushing out to put sandbags in place to prevent flooding, which occurs now. This also will draw in new merchants for a more unique shopping area that is close to home and accessible.

I possess a commanding knowledge of administration, logistics and leadership. This knowledge will be used in all aspects as your councilman for District 2. Getting information out to the resident is vital and always has been important to me. We rely on information to make decisions, because without that information, the resident is left out of the loop, which is unacceptable, as a government official works for the resident. Only by walking and talking to the residents do you get a real feeling of what is going on in your district. Informing your residents in person builds a stronger bond and shows that you care about them as a person and that they are just not a number. I have Marines and soldiers from the squad, platoon and company levels with precision guidance, which produced superb results. By providing proper guidance and establishing working together, all involved will step up to the challenge to succeed and not allow outside influences to tamper with their decision-making process.

Campaign Contribution and Expenditure Documents

In response to requests for posting of the Political Sign Zoning for Marion County.

If a candidate can't follow the law while campaigning, are you really going to vote for that person?

Feel free to take pictures of the signs violating the law and email them to the blog email addy. I will post them.

Noncommercial opinion sign, as defined in section 734-501 shall be permitted, provided the following provisions are met:

(1) Noncommercial opinion signs may be displayed as freestanding signs, as follows:

(a) Number of signs per street frontage--Five (5).

(b) Maximum sign area--Six (6) square feet.

(c) Maximum sign height--Four (4) feet.

(d) Setback--Not within the public right-of-way, nor within the clear sight triangular area.

(2) Window sign--Regulated per the applicable zoning district provisions pertaining to window signs.

(3) Notwithstanding the limitations set forth in Section 734-201(m)(1), noncommercial opinion signs may be displayed on a sign face that has been

legally established to display advertising signs, in the same manner and size as an advertising sign is permitted to be displayed on the same sign

face.

(4) Noncommercial opinion signs shall have no time limits.

An Improvement Location Permit (ILP) shall not be required if the provisions noted above are satisfied.

Please read the things correctly and don't make snap judgments about money going out. If you read the description of the expenditure that would be helpful.

Someone already managed to post incorrect info in the last thread before I even got a chance to put this up.

One thing to also notice is that there are many records missing. For example, "In Kind" contributions. If Candidate "A" pays for Candidate "B's" yard signs, hand outs, fundraisers, etc. then those have to be recorded as "In Kind."

If someone has a campaign that has yard signs out with no outgoing money for them then they had to come from somewhere.

Things like that can be interesting when a candidate tells you to vote for them because they are doing a great job, but they can't fill out very simple paperwork.

Appointed Clerk Chris Duffer and Appointed Mayor Terry Dilk Hiding Documents Again

Well Well Well. I made a document request and even tried to make it easy on the poor overworked Appointed Clerk Chris Duffer by only asking for the total amount of the money spent on negotiating the Wastewater Settlement.

So what does Appointed Clerk Chris Duffer do? Instead of just providing me with the information he spends OUR tax money with Brian Bosma's Law Firm to hide the amount of money using a technicality.

The City Attorney HELPED the Clerk hide the total amount from YOU!

Is the amount so big that it will show that they really didn't save much money?

Now I would think that the first post and what Appointed Clerk Chris Duffer will say is that I screwed up and didn't request a document. You will see that I indeed did try to make it easy on the Clerk and he twisted it in order to hide the truth.

You will notice that the negotiation wasn't over a decade old like Clerk Duffer stated in his letter to the editor but only 5 years old when Joe Wright started the process with the help of the City Council.

Ask these questions of your Appointed Mayor and Clerk please.

1. How much did the City of Beech Grove spend negotiating the Wastewater Settlement?

2. Will they show you the total amount in writing?

3. Why on earth would they not want to disclose the amount?

4. What did you hope to prove by spending tax payer money to hide the amount spent from the public?

Another Records Request Denial from Appointed Clerk Chris Duffer

I am busy so someone else request something for once. Maybe Appointed Clerk Duffer will give them to someone else.

How about a Dilk/Duffer backer who might want to see for themselves instead of just taking their word for it?

This is what I was going to request before once again Appointed Clerk Duffer denied me access to public documents regarding the city.

What does he have to hide?

1. Copies of all the invoices and the reimbursement checks made out for the recent remodeling of City Hall. I was given information that Appointed Mayor Dilk and Appointed Clerk Duffer were given reimbursement checks for work done to City Hall. I can either prove or disprove this with all the documents but the Clerk wouldn't give them to me so we won't know.

2. The letter that we all got from Beech Grove and St. Francis Hospital regarding them abandoning the City. It has come to my attention that an invoice for the City of Beech Grove for half of the cost of that letter($1,200.00) is being paid by the RDC. Can the President of the RDC answer this for us? Remember, I know the answer to my own question before you answer.

I hope none of these documents known to exist don't disappear like 2 years of RDC meeting minutes did. You can't hide the paper trail from the City Checking account. Ask for the Cancelled checks just to make sure.

Here is the latest email that I sent to the Public Access Counselor regarding requesting Public Documents and the response from the Public Access Counselor.

You will find that it's pretty black and white as to my having access to the records myself and being able to copy them myself without taking up any time or effort on the part of the Appointed Clerk or his staff.

Well this morning Appointed Clerk Chris Duffer denied me access to the records I was seeking with Linda who works in the office as my witness.

I handed him a copy of the email, gave him time to take a look at it, then politely asked if I could make a request for some documents. At that time I was told by Appointed Clerk Duffer that he had 24 hours to consult with his attorney about the matter. I pointed out that no where in the emailed response did it say that in the statute and asked him to write that down and sign it for me. He refused. I then asked Linda to please witness the fact that Appointed Clerk Duffer had denied me access to documents and he promptly yelled at Linda to continue working. I feel bad that I may have caused Linda to get treated in a demeaning manner by her boss, but he had a choice on what to say to her.

Correction: I just spoke with the Public Access Counselor who stated that the Clerk does have 24 hours to consult an attorney. After 11:30am on 10/13/2011 if access is not granted then I was instructed to file another Formal Complaint with the PAC.

Again, what is so secret? What is there to hide?

By the way, I was only going to request 10 to 12 documents total that all could have been accessed in minutes since they were just produced in the last month. How hard would it have been for Appointed Clerk Duffer to have let me get what I needed and be on my way instead of being confrontational and disrespectful to his employee?

Why would Appointed Clerk Duffer need to call an attorney?

What is so secret about City Documents?

Why do both Appointed Mayor Dilk and Appointed Clerk Duffer both state on the Indpls Star bios that they are both committed to being "Open and Honest" about the City then deny simple access requests in the next breath?

The APRA also requires that a public agency protect its public records from loss, alteration, mutilation, or destruction, and regulate any material interference with the regular discharge of the functions or duties of the public agency or public employees. I.C. § 5-14-3-7(a). Section 7, however, does not operate to deny any person the rights secured by Section 3 of the APRA. I.C. § 5-14-3-7(c). In denying the use of personal equipment to make copies, the agency (i.e. City of Beech Grove) bears the burden to demonstrate how the use of one's own equipment to make copies of records would result in loss, alteration, mutilation, or destruction. Given that the a public agency must regulate any material interference with the regular discharge of the functions or duties of the agency or employees under Section 7, it is not uncommon that a public agency may set a mutually convenient appointment or series of appointments during business hours to allow you to continue to make the copies you seek.
Note that because the APRA mandates that agencies separate the dislcosable information from the non-dislcosable information, an agency (i.e. City of Beech Grove) may need to make copies of the records on their own. I.C. § 5-14-3-6. As such, those records that require copying in order to redact the non-dislcosable information from the dislcosable information can not be copied on one's own equipment. The requester should be provided the redacted copies pursuant to APRA. Copying costs will still apply to these copies.

I would say that we can count this project among all the others that Beech Grove has started over the years and never finished.

Unfinished RDC Projects of RDC President Terry Dilk who took out $6,000,000.00 in TIF Bond Loans and somehow now there is no money to pay for these projects.

Greenway - Spent the money.

Digital City - 600k over budget still doesn't work!

Drive around the Roundy Bout. It's still under construction after the announcement that it was finished. It even has equipment chained to it.

I got a phone call about the damage going on so I thought I would stop by this morning and get some pictures. In the course of taking them a guy in a pickup truck almost drove right thru the center of the Roundy Bout and Metro Bus took up half of the apron in the middle of the Roundy Bout just going straight thru.

Here is the question you ask appointed Mayor Dilk. "How much is the projected cost to repair this intersection yearly as opposed to the cost of repairs from the previous intersection?"

Personally I thought the Roundy Bout was a great idea in the beginning because I am used to driving on properly designed and constructed ones. Obviously trying to "Shoe Horn" in a Roundy Bout into a space not big enough for it wasn't the brightest idea.

I can bring my own copier and paper so that I am not incurring any expenses for the City. Maybe that will save some time and effort on the part of the Clerk of Beech Grove.

Now here is a question that you can answer for yourself.

If Appointed Clerk Duffer and Appointed Mayor Dilk were truly interested in being "Open and Honest" like they tell everyone with them also saying that "All you have to do is come to City Hall and "They will give you whatever you want to know." The why the delay until after the election with the information and the attempt at not giving me the information I asked for on another request?

Here is the 2nd complaint filed when Appointed Clerk Duffer tried giving me around 179 pages of crap that I didn't request instead of giving me the 18 to 19 pages I did. How much city money has Appointed Clerk Duffer wasted putting together documents that serve no purpose and putting more money in Brian Bosma's pocket by having his form write all the letters?

We now have a Mayor who is being paid around 64,000.00 by the city and he has another Full Time job on top of that so he hires a mayor to do the job for him at another 36,000 a year and calls it a savings for the City.

What conclusions could you draw from this comparison?

The challenger for Mayor is dedicated to service of the City while the Appointed Incumbent is spending close to 115,000 to 118,000 of our money including SS taxes, payroll tax, benefits, etc on himself and the Chief of Staff who is really running the city.

You will also notice that Appointed Mayor Dilk and Appointed Clerk Duffer obviously approve of Dennis Buckley's thoughts on improving Beech Grove. When they both got appointed to office the improvements had already been listed and they seem to be trying to get them all done before we vote for and Elected Mayor and Clerk in November.

Mayor Terry Dilk and three RDC members, Warren Whitaker, Mike Dinapoli, and Aaron Lamb had lunch on Main street yesterday discussing their plans to put Main Street in the TIF ZONE, and which businesses they wanted to keep and what businesses they wanted to squeeze.
You see they want to redo Main Street with the plans that Joe Wright had.
What they won't tell you is they will have to take a block south and a block north of Main Street to make the street wider, the buildings bigger, the parking behind and the entrance alleys or street.

Don't believe me, they will be announcing a bicycle lane on the north side of Main Street along with parallel parking on Main Street very very soon

Let me clear something up for Mike Masterson and all the others who deny having to use a couple houses both north and south of Main Street to create space for parking...

Joe Wright asked Dave Grenoble and I for a meeting many years ago to discuss the Main Street development.

He explained what they were going to do and showed us a copy of what I had seen in Jeff Cardwell's office about the plans for Main Street. He explained that in order to create more parking for businesses on Main Street they were going to have to tear down around 100 houses utilizing a few North and South of Main Street to create parking behind the businesses.

When you post that "It's not in the plans." You are right, we told Joe that the people of Beech Grove would have to be told up front and he and the other investors would have to "SELL" the idea to the city in order to get everyone to buy in he said that they were going to do it regardless and could he count on our support.

For Dave and I to sit back and watch these people back door people was a deal breaker for us. We politely thanked him for presenting it to us and we about our way.

These are facts, hook us up to lie detectors, voice stress, whatever. It happened no matter how much anyone wants to deny it.

Now it seems that Mayor Dilk and his band of whatever they are have been found continuing what Joe Wright started years ago.

I am both surprised and speechless at the blatant attempt by Clerk Duffer, Mayor Dilk, and Brian Bosma to circumvent the spirit of the Freedom of Information Act. The time given by yourselves to supply the public with the requested information is more than 2 months away and shockingly enough right after Election Day in November.

One could surmise from this that there is an attempt to hold back vital information from the public as to skew the Election unfairly in one direction.
Your response is unreasonable, political, and not within the spirit of your pledges when appointed to be open and honest with the dealings of the City of Beech Grove.

The City Attorney was reclassified to Office Manager then to City Court Clerk and was paid

equally from the General and Sewage Works funds. The City Council approved salary ordinance

did not

specify her salary as one to be allocated to the sewage utility. No documentation was provided to support
the salary allocation. A similar comment appeared in the prior Report B37772.
Various other employee salaries were allocated between the City and Wastewater Utility or paid
entirely by the Wastewater Utility with no documentation provided to support the Wastewater Utility's
portion.
Additionally, operating funds from the Wastewater Utility were also used to pay for general
expenses related to the City.
Disbursements should be paid from properly authorized line items. (Accounting and Uniform
Compliance Guidelines Manual for Cities and Towns, Chapter 7)
Sources and uses of funds should be limited to those authorized by the enabling statute,
ordinance, resolution, or grant agreement. (Accounting and Uniform Compliance Guidelines Manual for

Expenses paid from utility funds should be directly related to the operation of the municipally
owned utility. Expenditures for city and town operating costs should not be paid from utility funds. The

I have been getting these for years now just like I have said before.

In the mail, under the wipers on my car, emails from current candidates telling me to apologize for exposing the truth, and about once a week on the blog.

Just consider how far the people in office right now will go to try to shut someone up. Do you really want people like them in office running your city and spending your money?

The timing of the threats is also very interesting don't you think?

I don't get paid for doing this, they do.

I don't have any power to gain doing this, they want to keep theirs.

Prove the documents posted are false and they will be taken down. Until then why not try coming clean and helping us fix the city you have broken.

What is significant about this information request is that Clerk Duffer and Mayor Dilk are using City money to promote themselves in the election. They are leaving business cards from the City of Beech Grove at people's houses when they are out campaigning. Sounds like a little thing until you realize that appointed officials like Dilk and Duffer should know better and be better stewards of the City's money.

Facts -

1. The Intersection the Round A Bout is being constructed on is actually the responsibility of the City of Indpls. There was no need for Beech Grove to spend any money on it.

2. The Round A Bout is a Beech Grove Project, not an Indpls project. This was stated by the President of the RDC in the public meeting and has always been the case as no funds were spent by Indpls on this project.

3. The City of Beech Grove spent $180,000.00 prior to the awarding of the grant and will not be reimbursed by the grant funding.

Questions -

1. Why did the City of Beech Grove spend $180,000.00 on the City of Indpls's intersection?

2. Why is Mayor Dilk telling everyone that the project is an Indpls project when it is and always has been a Beech Grove project?

3. What fund did the 180k come from? General? RDC? Sanitation, or the savings from firing the dispatchers and selling their equipment.

4. How long will access to this intersection be affected?

5. Where is the funding coming from to repair the side streets affected by heavy trucks, buses, emergency vehicles, and car traffic?

At first I thought, How long could it take? There can't really be that many streets and corners that are jacked up right? As usual with the Dilk and Duffer Team I got myself into more than I really wanted to do. Frankly I am embarrassed that the streets and sewers look this bad.

In case you were curious, there are 133 streets that are in need of repair just in the areas that I visited. How can this happen? Ask Mayor Dilk, he said all you have to do is ask him a question and he will be glad to answer it. Unless of course you are WTHR News or myself then he doesn't answer emails or personal visits. How can someone be Mayor who won't even stand up for himself?

Please let me know the places I missed and I will get some shots of those. I wasn't able to do many places because they were in the shade and the detail doesn't come out too good.

At tonights council meeting, after reading the minutes from the last meeting praising the BGPD for the fine job patroling the parks, the council decided our boys in blue needed a liitle help on the weekends keeping the parks safe.
So they decided it was not a conflict of interest to hire Wm "Bud" Templin's security company to protect our parks.
Final approval will come at the next BOW meeting.

According to your Editorial in the local newspaper today Clerk Treasurer Duffer stated that the City of Indpls owes the City of Beech Grove $800,000.00. I would like to request the documents that support his claim and all other documents regarding the negotiations with Indpls concerning this issue.

HOW DID THIS HAPPEN? WHY DIDN'T WE PAY IT? BELOW THE DOCUMENT THERE ARE THE QUESTIONS THAT I AM SENDING TO CLERK DUFFER AND MAYOR DILK ABOUT THIS ISSUE.

If the email response that Mayor Dilk sent me below is true, then why isn't the $1,000,000.00 paid and why are we still paying 400% more for our Sanitation than we were before? Read the bold black print in the email response please.

Kevin,

There are 231,000 feet of sanitary sewer. The city televised and cleaned and repaired all of the sanitary system, plus the storm water system where needed.

2. How much money is currently in the Sanitation Fund?

2a. How much money from the Sanitation Fund was transferred to the General Fund from 2005 thru 2010?

3. What are the yearly end of year balances from 2005 thru 2010? Just the last bill for each year please, no need for all of them.

4. What is the date that the last Sanitary Sewer repair was completed?

5. What are your plans to repay this debt?

6. When can I expect an answer to the questions I submitted in an email on both June 17th and June 27th on the Digital City Project and the Cameras in the Park Issue?

7. Why does Clerk Duffer feel it necessary to contact and spend money with the City Attorney when anyone requests information from him? Is this not a waste of our money when he should have a clear understanding of the Freedom of Information Act by now?

I would also still like for the documents to be free of any Editorial remarks from Clerk Duffer or any other member of the current administration. Clerk Duffer's refusal to do this was very disturbing and not in the spirit of the Freedom of Information Act. I am still waiting for word of when my copy of the Wastewater Bill will be ready.

I had sent this email 10 days ago. Could you please respond in a timely fashion to the questions I asked below? They appear to be reasonable questions and even though Mayor Dilk has 2 full time jobs I would think 10 days is plenty of time to answer questions which he should know off of the top of his head since he was President of the RDC while Digital City was being planned and implemented.

It was my understanding that when then RDC President and now Mayor Dilk signed the paperwork for Digital City that issues like this would be solved and all we would have to do is purchase cameras and plug them wirelessly into the network.

Could you please explain why we can not use the Digital City network for these cameras?

How many different bids are we getting for the cameras and their installation?

Is the only price we have gotten from BOW Member Bob White's company?

The current City I.T. coordinator is the same one that has worked on Digital City since 2007 and the system is non functional, is this a good idea to continue to use him?

What is the timeline for this project? Meaning when can we reasonably expect completion?

Where is the funding coming from? What budget section and how much is the current estimated cost?

Lastly, is it still the policy of Mayor Dilk to allow Parks Board members to carry handguns to meetings? I for one was very surprised when Parks Board Member Prindle announced his possession of the handgun at your meeting in the Beech Grove Little League Building on the Little League grounds that I attended.

The Park Board, Mayors Office and B.G. Police are working closely to get the camera project from the planning stage to operation. The cities I.T. coordinator has met with the equipment supplier and is making certain the equipment will function properly with the cities communication network.
